Abstract

العنوان :"النظام القانوني للتعاقد الإلكتروني في مجال الصفقات العمومية (دراسة مقارنة)"

الملخص: تبنت الحكومة الجزائرية على غرار الكثير من التشريعات رقمنة الصفقات العمومية، حيث ظهرت الرغبة في نزع الصفقة المادية عن إجراءات إبرام الصفقة العمومية، باعتبار أنّ عصر المعلوماتية غزى كلّ المعاملات، وأثر بصفة مباشرة على تكوين الصفقة وتنفيذها، كما أثر على مبادئها من خلال تعزيز المنافسة والمساواة وتكريس الشفافية الإدارية في ظل الإعلان الإلكتروني. وكذا القضاء على البيروقراطية الإدارية والجرائم التقليدية. غير أنّ عدم التجسيد الفعلي للبوابة الإلكترونية للصفقات حال دون خلق نظام قانوني متكامل للمعاملات الإلكترونية للصفقة العمومية.

Le gouvernement algérien a adopté, à l'instar de nombreuses législations, la numérisation des marchés publics, qui a engendré la suppression de la transaction matérielle dans les procédures de conclusion de la transaction publique. Comme L'ère des technologies de l'information a envahi toutes les transactions, cela a directement affecté la formation et la mise en œuvre de la transaction, et a également affecté ses principes en favorisant la concurrence et l'égalité. Et il a un impact sur le renforcement de la transparence administrative à la lumière de la publicité électronique et d'éliminer la bureaucratie administrative et les crimes traditionnels. Cependant, l'absence d’une concrétisation effective du portail électronique des marchés publics a empêché la création d'un système juridique intégré pour les transactions électroniques des marchés publics. Les mots clés : marchés publics - le portail électronique - communication électronique et échange d'informations – dématérialisation.
