Résumé: الملخص (بالعربية) : تواجه خدمة الاستعجالات الطبية صعوبات ونزاعات بصفة دائمة مع مختلف المصالح الطبية الأخرى، ما أدى إلى التشريعات والسياسات الصحية، ومنها المشرع الجزائري والفرنسي إلى إعادة النظر في المنظومة الخاصة بهذه الخدمة، بهدف خلق روح التعاون بين مهني الصحة وبين المستشفى والمؤسسات والهياكل الصحية الأخرى. ولتحقيق هذا الهدف، تم تقنين مجموعة من القواعد، ما يترتب عنها قيام مسؤوليات على كل مخالف لها. ومن جملة هذه القواعد نجد الالتزام بإعلام المريض وضرورة الحصول على رضاه، حماية كرامة المريض وما ينتج عنها من حقوق أخرى. فإحترام هذه القواعد، نتج عنه نشوء حقوق لدى المريض من جهة، والتزامات تقع على عاتق الطبيب من جهة أخرى، كالالتزام بمعالجة المريض وابعاد الخطر عنه خاصة في الحالات الاستعجالية. ولكن ما يميز الحالة الاستعجالية، هي السرعة في التدخل والسرعة في العمل أو رد الفعل، وهذا ما قد يؤدي إلى خلق نزاعات بين الطبيب المتدخل والمريض أو من يمثله، وبالتالي فالمشكل الأول الذي يطرح، هل هناك حالة استعجالية أم لا؟ والتي إما أن تسمح للطبيب بالتدخل أو لا، لأن الحالة الاستعجالية هي حالة استثنائية وبالتالي هناك عدالة استثنائية خاصة لمثل هذه الحالات، والتي يمكن للطبيب الاستفادة منها. الكلمات المفتاحية: الاستعجالات الطبية، أخلاقيات الطب، الخطر الحال، المساعدة الطبية المستعجلة، مسؤولية الطبيب، الطبيب المنظم حقوق المريض، التزامات الطبيب Résumé (en Français) : Le Service médical d'urgence est confronté à des difficultés et à des différends constants avec divers autres intérêts médicaux, ce qui a conduit à la législation et aux politiques en matière de santé, y compris les législatures algérienne et Français, à revoir le système de ce service, dans le but de créer un esprit de coopération entre les professionnels de santé et l'hôpital et les institutions. et d'autres structures de santé. Pour atteindre cet objectif, un ensemble de règles a été codifié, ce qui a donné lieu à des responsabilités pour chaque contrevenant. Parmi ces règles, nous trouvons l'obligation d'informer le patient et la nécessité d'obtenir son consentement, de protéger la dignité du patient et les droits qui en découlent. Le respect de ces règles a entraîné l'émergence des droits du patient d'une part, et des obligations du médecin d'autre part, telles que l'obligation de traiter le patient et de garder le risque loin de lui, en particulier dans les cas urgents. Mais ce qui distingue l'urgence, c'est la rapidité d'intervention et la rapidité d'action ou de réaction, qui peuvent conduire à des conflits entre le médecin interventionniste et le patient ou son représentant, et donc le premier problème se pose, y a-t-il un cas d'urgence ou non? Ce qui permet au médecin d'intervenir ou non, parce que la situation d'urgence est exceptionnelle et donc il y a une justice exceptionnelle spéciale pour de tels cas, dont le médecin peut bénéficier. Abstract (en Anglais) : The Emergency Service faces constant difficulties and disputes with the other medical services, which has led the legislation authorities, both in Algeria and France, to reconsider the operating system of such service. In order to create a spirit of cooperation among the health practitioners, the hospital, companies and other health services, a set of laws have been inaugurated. Subsequently, staff are responsible for such laws violation. Among these laws is the obligation to inform the patient and seek his consent, respect his dignity, and any other subsequent rights. Compliance with these rules has led to the emergence of the patient's rights which in turn are considered obligations for the doctors such as the obligation to treat the patient and keep the risk away from him, especially in urgent cases. However the medical emergency is characterized by the speed of intervention and the speed of action or reaction which can cause conflicts between the interventionist doctor and the patient or his representative. Thus, a problem emerges in the sense that is there a case emergency or not? The latter could either necessitate the doctor’s intervention or turn it useless due to the fact the emergency situation is exceptional and therefore there is exceptional jurisdiction for such cases which doctors could benefit from.
