الحياد التجاري للمرفق العام (دراسة مقارنة)

Abstract

الملخص (بالعربية) : تكمن وظيفة الدولة في خلق المرافق العامة وفقا لاحتياجات مواطنيها، وتتمثل غايتها أساسا في تحقيق المنفعة العامة، وهذا هو الهدف الأصيل لها، ومن ثمة فإنها لا تمارس الأعمال التجارية ولا تستهدف الربح الشيء الذي يكرس الحياد التجاري للمرفق العام. غير أن الاتجاهات الجديدة للمرفق العام بعد التطورات الحاصلة على وظيفة الدولة، والعوامل التي تدخلت في تغيير نمط المرفق العام، تماشيا مع التحولات الاقتصادية والسياسية والتكنولوجية أثرت على منحنيات أهداف المرفق العام وطرق تسييره، إذ أنه أصبح لا يكتفي بتحقيق المنفعة العامة الاجتماعية وإنما تطورت هذه المنفعة إلى منفعة عامة اقتصادية تتحقق بتوجه المرفق العام إلى تحقيق الربح والمردودية واتباع طرق المنافسة، كما أضحت تعتمد في المعاملات التجارية على نفس الأساليب المستخدمة من طرف الأشخاص العادية، كما تم فتح باب المنافسة أمام القطاع العام لتسييره من طرف القطاع الخاص، ومن هذا المنطلق أصبح نطاق الحياد التجاري يضيق في كل مرحلة من المراحل التي تفتح فيها الدولة المبادرة الخاصة للمساهمة في تسيير وإدارة المرفق العام. الكلمات المفتاحية: المرفق العام، المنفعة العامة، الحياد التجاري، المنفعة العامة الاقتصادية، المنافسة

Résumé (en Français) : La fonction de l'État consiste à créer des services publics en fonction des besoins de ses citoyens, et son objectif principal est d'atteindre l'intérêt public, et c'est son objectif initial. Par conséquent, il ne s'engage pas dans des activités commerciales et ne vise pas le profit, ce qui consacre la neutralité commerciale du service public. Cependant, les nouvelles tendances du service public après les évolutions de la fonction étatique, et les facteurs qui sont intervenus pour modifier le modèle du service public, en lien avec les transformations économiques, politiques et technologiques, ont affecté les courbes des objectifs de la service public et ses modes de gestion, car il ne s'est pas contenté de réaliser le bien public social, mais a plutôt développé ce bien A un bien public économique qui est atteint par l'orientation du service public vers le profit et la rentabilité et suivant les méthodes de la concurrence, puisqu'il est devenu dépendant dans les transactions commerciales des mêmes méthodes utilisées par les personnes ordinaires, et la porte de la concurrence a été ouverte pour que le secteur public soit géré par le secteur privé, De ces points de vue, le champ de la neutralité commerciale s'est resserré à chaque étape où l'État ouvre l'initiative privée pour contribuer à la gestion et à la gestion du service public. Abstract (en Anglais) : The function of the state is to create public services according to the needs of its citizens,and its main objective is to achieve the public benefit, and this is its original objective.
