Abstract

الملخص (بالعربية) :

إن تطور التشريع الرياضي ومواكبته للنشاط الرياضي أدى بالمقابل إلى تطوير مهام الاتحادية الجزائرية لكرة القدم ، بصفتها جمعية متخصصة في التسيير والاشراراف على نشاط كرة القدم في الجزائر، وبهذه الصفة أعطاها التشريع الوطني ضمانات دعمت قوة سلطتها كهيئة رياضية مستقلة في إنشاء هياكلها وإصدار قراراتها في إطار مهامها الرياضية، كما منحها انضمامها للهيئات الدولية والقارية والاقليمية والجهوية إمتيازات السلطة في ميدان التسيير والاشراف، وبهذا اكتسبت حصانة وطنية ودولية حجبت عنها تدخل السلطات العمومية المشرفة على القطاع الرياضي وسهلت قيامها بمهامها. وقد تمتد آثار النظام التشريعي للاتحادية الجزائرية لكرة القدم إلى فرض إلتزامات على هذه الأخيرة من أجل تطوير إختصاصها، فبالاضلفة إلى إلتزامها بالقيام بالخدمة العمومية بصفتها مرفق عمومي رياضي، هناك إلتزمات أخرى نذكر منها: - الالتزام باحترام مبادئ وقواعد الحكم الراشد وتنفيذها. - الالتزام بالوقاية من العنف الرياضي ومكافحته. - الالتزام بالوقاية من تعاطي المنشطات ومكافحتها. الكلمات المفتاحية : اتحادية رياضية؛ جمعية متخصصة؛ الحكم الراشد، العنف الرياضي؛ المنشطات. ----------------------------------------------(en Français) :

L'évolution de la législation sportive et de son activité sportive d'accompagnement a conduit à son tour à développer les missions de la Fédération Algérienne de Football, en tant qu'association spécialisée dans la gestion et l'encadrement de l'activité footballistique en Algérie, et à ce titre la législation nationale lui a donné des garanties qui a soutenu la force de son autorité en tant qu'instance sportive indépendante pour établir ses structures et rendre des décisions dans le cadre de ses missions. Son adhésion aux instances internationales, continentales et régionales lui a également conféré des privilèges d'autorité dans le domaine de la gestion et de la supervision, et acquiert ainsi une immunité nationale et internationale qui empêche l’intervention des pouvoirs publics encadrant le secteur sportif et lui facilite l'accomplissement de ses missions. Les effets du dispositif législatif de la Fédération Algérienne de Football peuvent aller jusqu'à imposer à cette dernière des obligations en vue de développer sa compétence, en plus de son obligation d'assurer le service public en tant qu'établissement sportif public, il existe d'autres obligations, notamment : - Engagement à respecter et mettre en œuvre les principes et règles de bonne gouvernance. - Engagement dans la prévention et la lutte contre la violence sportive. - Engagement dans la prévention et le contrôle du dopage. The evolution of sports legislation and its accompanying sports activity has in turn led to the development of the missions of the Algerian Football Federation, as an association specializing in the management and supervision of football activity in Algeria, and as such the national legislation gave it guarantees which supported the strength of its authority as an independent sports body to establish its structures and make decisions within the framework of its missions, its adherence to international bodies, continental and regional authorities has also conferred on it privileges of authority in the field of management and supervision, and thus acquires a national and international immunity which prevents the intervention of the public authorities supervising the sports sector and facilitates the accomplishment of its his missions. The effects of the legislative mechanism of the Algerian Football Federation can go so far as to impose on the latter obligations with a view to developing its competence, in addition to its obligation to provide public service as a public sports establishment, there are other obligations, including: - Commitment to respect and implement the principles and rules of good governance. - Commitment to preventing and combating sports violence. - Commitment to doping prevention and control.
