الملخص(بالعربية): الملخص: يعتبر حياد الإدارة من سمات الدولة الديمقراطية، والحياد عنصر بالغ الأهمية لاستمرارية مؤسسات الدولة واستمرارية المرافق العامة. لذلك يجب الحفاظ على جوهر مبدأ الحياد والحرص على التقيد به، وهو ما يفرض إبعاد الموظف العام عن كل ما من شأنه التأثير على عمله من خلال إيجاد ضمانات قانونية، قضائية ورقابية. فضلا عن تحميل المسؤولية الإدارية عند المساس بهذا المبدأ. الكلمات المفتاحية: الحياد- الإدارة – الموظف العام – القانون الجزائري – القانون الفرنسي .

---------------------------------------------- Résumé La neutralité de l’administration est une caractéristique de l’état démocratique. La neutralité est un élément essentiel pour la continuité des institutions de l’état et ses services publics. Et pour cela l’essence du principe d’impartialité doit être préservée et respectée, qui exige que le fonctionnaire soit éloigné de tout ce qui pourrait affecter son travail en créant des garanties juridiques et judiciaires. En plus d’assumer la responsabilité administrative en cas de violation de ce principe. Les mots clés :neutralité – administration- fonctionnaire-droit algérien –droit français. ----------------------------------------------Abstract : The neutrality of the administration is one of the characteristics of a democratic state. Neutrality is an important element for the continuity of state institutions and of its public utility. Therefore, the essence of the principle of impartiality must be preserved and adherence to it, which imposes the removal to the public employee from everything that might affect his work by finding legal, judicial, and regulatory guarantees.
