Abstract

الملخص (بالعربية) : العنوان :"جودة الأحكام القضائية-دراسة مقارنة-"

يعتبر القضاء أساس العدل و السبيل لحماية الحقوق و الحريات و رفع المظالم و الركيزة الأساسية التي تقوم عليها دولة القانون ، حيث تتجلى مهمة القضاة في إصدار الأحكام القضائية من خلال احترام و تطبيق جملة من المبادئ و الضمانات الهيكلية الإجرائية و الموضوعية ذات الصلة بحق الشخص في محاكمة عادلة في مختلف مراحل الدعوى، و إلى غاية صدور الحكم التي تعتبر من الحقوق الأساسية للإنسان المعترف بها له و أكدته المواثيق و الشرائع الدولية و الوطنية. و تتحقق الجودة في إصدار الأحكام القضائية من خلال التطبيق الجيد للقانون و حماية الحقوق التي لا تتحقق إلا من خلال نظام فضائي مستقل و نزيه الذي يأمن معه الأفراد على حقوقهم في صدور أحكام صحيحة و مطابقة للحقيقة، تعزز و تكسب ثقتهم في المؤسسة القضائية يتحقق من خلالها الأمن القضائي الذي يعد من أهم أساسيات و ضمانات جودة الأحكام القضائية.

The judiciaryis the basis of justice and the way to protectrights and freedoms and to lift grievances and the basic pillar of the rule of law, where the task of judgesismanifested in issuingjudicialjudgments by respecting and applying a number of principles and structural procedural and substantive safeguardsrelated to the right of the person to a fair trial at various stages of the case, and to the end of the judgmentwhichisconsidered one of the fundamentalrights of the humanbeingrecognized and confirmed by international and national conventions and laws. The quality of judicialsentencingisachievedthrough the good application of the law and the protection of rightsthat are achievedonlythrough an independent and impartial space system withwhichindividuals are guaranteedtheirrights to makevalid and truth-basedjudgments, strengthening and gainingtheir confidence in the judicial institution throughwhichjudicialsecurityisachieved, whichis one of the most important fundamentals and guarantees of the quality of judicialjudgments.

Le pouvoir judiciaire est la base de la justice et la manière de protéger les droits et libertés et de lever les griefs et le pilier fondamental de l’État de droit, où la tâche des juges se manifeste dans l’émission de jugements judiciaires en respectant et en appliquant un certain nombre de principes et de garanties structurelles procédurales et substantielles liées au droit de la personne à un procès équitable à différentes étapes de l’affaire, et jusqu’à la fin du jugement qui est considéré comme l’un des droits fondamentaux de l’être humain reconnu et confirmé par les conventions et lois internationales et nationales . La qualité des peines judiciaires est obtenue grâce à la bonne application de la loi et à la protection des droits qui ne sont obtenus que par un système spatial indépendant et impartial avec lequel les individus sont assurés de leur droit de porter des jugements valides et fondés sur la vérité, de renforcer et de gagner leur confiance dans l’institution judiciaire par laquelle la sécurité judiciaire est assurée, qui est l’un des principes fondamentaux et des garanties les plus importants de la qualité des jugements judiciaires.
