الاختصاصات الاستشارية لمجلس الدولة الجزائري ( دراسة مقارنة).

Abstract

الملخص (بالعربية) :

لقد منح المشرع الجزائري لمجلس الدولة اختصاصات استشارية تمكنه من المساهمة في العملية التشريعية بهدف الوصول إلى سن تشريع جيد ومتطور، منسجما مع الدستور وغير متعارض مع القوانين الأخرى، غير أن هذه الاختصاصات لم ترقى لما وصلت إليه في النظم القانونية المقارنة خاصة في فرنسا، حيث تقتصر اختصاصات الاستشارية لمجلس الدولة الجزائري على مشاريع القوانين والأوامر الرئاسية فقط، وليس كما هو الحال عليه بالنسبة لمجلس الدولة الفرنسي الذي يتمتع باختصاصات استشارية تمتد إلى كل النصوص التشريعية والتنظيمية. الكلمات المفتاحية: الاستشارة، مجلس الدولة، اختصاصات استشارية، جودة التشريع. ---------------------------------------------- Résumé (en Français) : Le législateur algérien a donné au Conseil d’État des compétences consultatifs pour contribuer au processus législatif afin de parvenir à une législation de qualité et sophistiquée, conforme à la Constitution et non incompatible avec d’autres lois , Toutefois, ces compétences n’ont pas été à la hauteur de leur niveau dans les systèmes juridiques comparatifs, notamment en France, où les compétences consultatifs du Conseil d’État algérien se limitent aux seuls projets de loi et ordonnances présidentiels, et non comme c’est le cas du Conseil d’État Français, qui dispose de compétences consultatifs s’étendant à tous les textes législatifs et réglementaires.

Les mots clés: Consultation, Conseil d’État, compétences consultatifs, Qualité de la législation . ---------------------------------------------- Abstract (en Anglais) : The Algerian legislator has given the Council of State Advisory terms of reference to contribute to the legislative process in order to reach good and sophisticated legislation, consistent with the Constitution and not incompatible with other laws, However, these terms of reference have not lived up to their level in comparative legal systems, particularly in France, where the advisory powers of the Algerian Council of State are limited to presidential bills and orders only, not as is the case with the French Council of State, which has advisory powers extending to all legislative and regulatory texts.
