المسؤولية الجزائية للشخص المعنوي عن الجريمة المتعلقة بالصرف

Abstract

الملخص (بالعربية) : تعد المسؤولية الجزائية للشخص المعنوي عن جريمة الصرف، من أهم المواضيع التي تحتل مكانا بارزا في التشريعات الجزائية الاقتصادية، بفعل ما تنطوي عليه من تهديد حقيقي للسياسة الاقتصادية للدولة، وعلى هذا الأساس فإن التشريع الصرفي الجزائري كان سباقا في إقرار المسؤولية الجزائية للأشخاص المعنوية في حالة خرق القواعد المتعلقة بتنظيم الصرف وحركة رؤوس الأموال من وإلى الخارج، حيث حرص المشرع على وضع الإطار العام لهذه المسؤولية بشكل يوفر حماية حقيقية للقيم المحمية جزائيا في المجال الصرفي.

Résumé (en Français) :

La responsabilité pénale de la personne morale pour l’infraction de change est considérée comme l'un des sujets les plus importants qui occupe une place prépondérante dans la législation pénale économique, en raison de la menace réelle qu'elle représente pour la politique économique de l'État. C'est sur cette base que la législation de change algérienne a été proactive en établissant la responsabilité pénale des personnes morales en cas de violation des règles relatives à la réglementation des changes et des mouvements de capitaux à destination et en provenance de l'étranger, amenant le législateur à définir le cadre général de cette responsabilité de manière à assurer une réelle protection des valeurs protégées pénalement dans le domaine des changes.

Abstract (en Anglais) :

The criminal liability of legal persons for the crime of exchange is considered to be one of the most important subjects which occupies a prominent place in economic criminal legislation, because of the real threat which it represents for the economic policy of the State. It is on this basis that Algerian exchange legislation has been proactive in establishing the criminal liability of legal persons in the event of violation of the rules relating to exchange regulations and the movement of capital to and from abroad, bringing the legislator to define the general framework of this responsibility so as to ensure a real protection of the values protected criminally in the field of the exchanges.
