الحق في النقد بين الإباحة والتجريم

Abstract

الملخص (بالعربية) :

الملخص: إن الحق في النقد هو حق كل شخص في إبداء رأيه إزاء تصرف واقع أو موضوع موجود يهم المجتمع بقصد النفع العام بصورة موضوعية وباستخدام العبارات الملائمة لذلك، فهو جوهر حرية الرأي ومحتواها، بحيث لولاه لما تطور المجتمع ما وصلنا إلى الحضارة التي نعيشها الآن، غير أن هذا الحق كغيره من الحقوق ليس مطلق، بحيث لا يجوز استخدام الحق في النقد بقصد الإضرار بالغير وتحقيق منافع خاصة بعيدة عن النفع العام.

Résumé (en Français) : Intitulé: «Le droit de critique entre l’exhumation et la criminalisation» Résumé : Le droit de critique est le droit de toute personne d’exprimer son opinion sur une réalité existante ou un sujet d’intérêt pour la société en vue de l’utilisation objective et appropriée de la langue appropriée, qui est l’essence de la liberté d’opinion et son contenu, de sorte que sans elle, la société ne se développera pas dans la pratique et atteindre la civilisation dans laquelle nous vivons maintenant. Cependant, comme d’autres droits, ce droit n’est pas absolu, de sorte que le droit de critique ne puisse pas être utilisé dans le but de nuire à autrui et d’obtenir des avantages privés et des fins l’oins des intérêts public.

Droit de critique, liberté d’opinion, droit à la réputation, liberté de l’individu, responsabilité juridique.

However, like other rights, this right is not absolute, so that the right of criticism cannot be used for the purpose of harming others and obtaining private benefits and purposes from the general interests.
