المسؤولية الجزائية لمنتجي الدواء

Abstract

حضيت المنتجات الدوائية بأهمية قصوى نظرا لخصوصيتها وطبيعتها الحسّاسة، فضلا عن مكوناتها المعقدة وطبيعتها السّمية في بعض الأحيان، وهذا تماشيا مع التطورات الابتكارية الحديثة في إطار صنعها في الوقت الراهن، لاسيما في مجال إقرار المسؤولية الجزائية لمنتجيها، الأمر الذي يتطلب ضرورة التقيد بضوابط قانونية عند صنع الدواء وتداوله؛ كما أن ذلك لا يتحقق إلا بفرض جملة من الالتزامات الفنية والقانونية على منتجي الدواء تحت طائلة الجزاء في صورة المسؤولية الجزائية لمنتجه سواءا كان شخصا طبيعيا أو شخصا معنويا متى تعلق الأمر بالشركة الصيدلانية المنتجة للدواء. وهذا ما يمكن ترجمته في العديد من الجرائم ذات الصلة بصناعة الأدوية، وما ينجم عنها من آثار قانونية يُبرز من خلالها دور القاضي الجزائي المعروض أمامه النزاع لما له من سلطة تقديرية واسعة في مجال المفاضلة بين وسائل الإثبات عند تسبيب حكمه، وكذا فرض العقوبة المقررة مع مراعاة أسباب انقضائها تكريسا لقرينة البراءة في مجال الدعوى العمومية وإنصاف الضحايا المتضررين من استهلاك الدواء وتعويضهم عند تأسيسهم كطرف مدني في مجال الدعوى المدنية بالتبعية. الكلمات المفتاحية: منتجات دوائية - منتج دواء- التزامات - إخلال- جرائم- مسؤولية جزائية - قاضي- عقوبة. ---------------------------------------- Résumé (en Français) La spécifité des produits pharmaceutiques en a fait la plus grande importance en raison de la complexité de ses composants et de sa nature toxique, en ligne avec les développement innovants récents dans le domaine de l'établissement de la responsabilité pénale, cela nécessite le respect des contrôles légaux lors de la fabrication et de la manipulation des médicaments, les producteurs sont tenus de respecter les obligations techniques et légales sous peine pour la personne physique ou morale quand il s'agit de l'entreprise pharmaceutique qui produit le médicament. Cela se traduit par de nombreux crimes liées aux produits pharmaceutiques et leur applications juridiques montre le rôle du juge avant le litige en raison de son pouvoir discrétionnaire dans le domaine du compromis entre les moyens de preuve quand causer son jugement, ainsi que l'imposer la peine prescrite sous réserve des raisons de son expiration consécration de la présomption d'innocence dans le domaine de l'action publique et réparation pour les victimes affectées par la consommation de médicaments et les indemniser en tant que partie civile pour action civile par association.

The fact that requires the full respect of legal controls when making and distributing medicine. However, this will not be possible unless a set of artistic and legal obligations are issued in the sense that the producers, whether natural or legal persons, must take the criminal responsibility of their products. The above mentioned problem can be easily shown in numerous pharmaceutical crimes and their legal repercussions. The role of the criminal court judge is clear since he owns a considerable discretionary authority that he can use in differentiation between evidence and sentence reasons as well as punishing with respect to the causes of its expiration in order to valorize the presumption of innocence in the field of public action and to be right with the victims and redress them as a civil part.
