دور القانون الدولي في حماية البيئة

Abstract

لقد كان للقانون الدولي دورا هاما في حماية البيئة من جميع جوانبها و إن الحماية تعني المسؤولية و أهمهما المسؤولية الدولية خصوصا في مجال تغير المناخ .و إن دراسة هذه المسؤولية عن أضرار التلوث أصبحت مجال اهتمام المجتمع الدولي . و بالرغم من التطور الحاصل في هذا المجال ، سواء فيما يتعلق بالأساس الذي تستند إليه ، أو من ناحية تحديد المسؤول عن الضرر أو بالنسبة لحدود هذه المسؤولية ، فإنها تبقى مقيدة بحدود قصوى ، الأمر الذي أدى إلى خلق وسائل جديدة لمعالجة هذا الأمر. الكلمات المفتاحية: الضرر البيئي – المسؤولية الدولية – التعويض – المؤتمرات الدولية --------------------------------------- Résumé (en Français) : Le droit international joue un rôle important dans la protection de l'environnement sous tous ses aspects, cette protection signifie, particulièrement, la responsabilité internationale dans le domaine de changement climatique , et que l'étude de cette responsabilité, de dégâts de pollution, est devenue le centre d’intérêt de la communauté internationale. Malgré le progrès réalisé dans cette domaine, surtout en ce qui concerne le principe sur lequel repose l’identification du responsable des dégâts ou des frontières de cette responsabilité, il reste contraint par des limites, qui ont mené à la création des nouveaux moyens de traiter cette question. Mots-clés – Dommages à l’environnement - Responsabilité Internationale Rémunération - Conférences Internationales -------------------------------------- Abstract (en Anglais) : International law plays an important role in the protection of the environment in all its aspects, this protection means, in particular, international responsibility in the field of climate change, and that the study of this responsibility, of pollution damage, has become the focus of the international community. Despite the progress made in this area, especially with regard to the principle on which the identification of the person responsible for the damage or the frontiers of this responsibility is based, it remains constrained by limits, which have led to the creation of new ways of dealing with this issue.
