الحماية الإجرائية للوظيفة العامة –دراسة مقارنة -

Abstract

تتناول في هذه الدراسة طرحا مختلفا عن الدراسات السابقة كونها تسلط الضوء على تلك الجوانب الإجرائية التي لم تلقى اهتماما لدى الباحثين في المجال القانوني رغم أنها في الحقيقة توفر حماية فعالة للوظيفة العامة ولعل ما يؤكد جدية هذا الطرح ضرورة وجود سلطة فعالة لملاحقة الجرائم الماسة بالوظيفة العمومية والذي يشكل أيضا أحد العناصر الأساسية في منظومة مكافحة الفساد والتي تتجسد من خلال إنشاء أجهزة إدارية متخصصة ومستقلة في أعمال التحري والكشف عن العديد من الجرائم المخلة بنزاهة الوظائف العامة. الكلمات المفتاحية : الوظيفة العامة - الموظف العام - الحماية الإجرائية - الملاحقة الإجرائية ---------------------------------------Contrairement aux études précédentes, cette étude traite le sujet autrement, car elle met en lumière les aspects procéduraux qui n'ont pas retenu l'attention des chercheurs dans le domaine juridique. Bien qu'en réalité, elle assure une protection efficace de la fonction publique, et constitue également l'un des éléments fondamentaux du système anti-corruption qui s'incarne dans la mise en place d'organes administratifs spécialisés et indépendants chargés d'enquêter et de détecter de nombreux délits contre l'intégrité de la fonction publique. Although in reality it provides effective protection for the public service, and is also one of the fundamental elements of the anti-corruption system which is embodied in the establishment of specialized and independent administrative bodies responsible for investigating and to detect numerous crimes against the integrity of the public service.
