--------------------------------------------------------------------------------------------------------resume en arabe-------------------------------------------------------------------------------------------الاختصاص القضائي في الصفقات العمومية ينقسم إلى اختصاص في منازعات الصفقات العمومية و الذي يتوزع بين القضاء الإداري و القضاء العادي حسب المعيار العضوي المكرّس في القانون الجزائري،وإلى الاختصاص في نظر الجرائم التي ترتكب بمناسبة صفقة عمومية،و الذي يؤول إلى الأقطاب الجزائية المتخصصة حسب قانون الوقاية من الفساد ومكافحته و قانون الاجراءات الجزائية الجزائري.-----------------------------------------------------------------------------------------------------------------------------------resume en français------------------------------------------------------------------------------------------- La compétence juridictionnelle en matière de marchés publics comporte deux branches،on distingue d’une part la compétence au plan du contentieux des marchés publics qui relève tant du juge administratif que des juridictions de droit commun en application du critère de répartition adopté par le législateur algérien ; d’autre part la compétence en matière de poursuite des infractions commises en relation avec la conclusion d’un marché public et qui relève de la compétence des pôles pénaux spécialisés et ce, en application des dispositions de la loi relative à la prévention et à la lutte contre la corruption et de celles du code de procédure pénale.-----------------------------------------------------------------------------------------------------------------------resume en anglais------------------------------------------------------------------------------------------------There are two branches of jurisdiction in public procurement: on the one hand there is jurisdiction over public procurement litigation, which falls to both the administrative judge and the ordinary courts in application of the distribution criterion adopted by the Algerian legislature. ; on the other hand, jurisdiction over the prosecution of offenses committed in connection with the conclusion of a public procurement and which falls within the competence of the specialized penal centers, in accordance with the provisions of the Law on the Prevention and fight against corruption and those of the Code of Criminal Procedure.
