Abstract

يعتبر موضوع الحماية القانونية للآثار من أهّم المواضيع التي حظيت باهتمام على الصعيدين الدولي والوطني، واعتبارا للقيمة المادية والمعنوية التي تحوزها الآثار، فقد أولى المجتمع الدولي عناية من خلال إبرام العديد من الاتفاقيات والبروتوكولات الدولية المقررة لحماية الآثار سواء أثناء السّلم أو أثناء النزاعات المسلحة ، ناهيك عن الدور الذي لعبته المنظمات الدولية والإقليمية في تفعيل وترسيخ الحماية الدولية الآثار. ولم تقتصر حماية الآثار وصونها على الجهود الدولية فقط، وإنما تعدّت ذلك إلى تضافر جهود وطنية والتي تعتبر في حدّ ذاتّها ضمانات قانونية مكرّسة لحماية الآثار والمتمثلة في سّن القوانين والتنظيمات المهتمة بحمايتها فضلا عن تقرير مسؤولية مدنية وجنائية ، بالإضافة إلى إنشائها للعديد من المؤسسات والأجهزة المكلّفة بذلك ،وهو ما قامت به جّل التشريعات الوطنية La question de la protection juridique du patrimoine est l’un des sujets les plus importants de l’attention internationale et nationale: compte tenu de la valeur matérielle et morale du patrimoine, la communauté internationale a veillé à la conclusion de nombreuses conventions et protocoles internationaux pour la protection du patrimoine, que ce soit en temps de paix ou en conflit armé.
