الجزاء الدولي ومدى فاعليته

Abstract

الملخص (بالعربية) + (الفرنسية) + (الإنجليزية): يعتبر الجزاء الدولي من مواضيع الساعة، ومن أكبر تحديات العصر نظرا لما يعيشو المجتمع الدولي من جسامة االنتياكات الدولية ألحكام القانون الدولي. فالجزاء الدولي ىو كل تدبير أو اجراء يطبق ضد المنتيك الدولي ضرورة احترام مبدأ الشرعية الدولية في ذلك، ومراعاة كل مبادئ األمم المتحدة حين تنفيذه خاصة مبدأ حماية حقوق االنسان، ولعل ىذا ىو أىم دافع أدى الى البحث عن نوع جديد من الجزاءات الدولية سميت بالجزاءات الدولية الذكية. وقد حمل تاريخ الجزاء الدولي خاصة بعد انشاء منظمة األمم المتحدة العديد من التطبيقات التي أكدت عمى ضرورة معاقبة المنتيك الدولي، وقد تم انشاء منظومة مؤسساتية في سبيل تنفيذ ذلك. اال أن عوائقا كثيرة تقف أمام تفعيل توقيع الجزاء الدولي منيا االنتقائية واالزدواجية وتأثير حق الفيتو عمى القرارات الدولية الجزائية، وكذا اتخاذ جممة من الذرائع لتطبيق الجزاء الدولي بما يتماشى مع سياسات الدول الكبرى.

RESUME :

International sanctions is one of the most inportant problems of the day, and one of the greatest challenges of our time , given the experience of the international community in the seriousness of international violations of international law. International sanction is any measure or measure applied against the international offender with the need to respect the principles of the United Nations whene it is implemented, in particular the principle of the protection of humen rights the . This is perhaps the most important reason that led to the search for a new type of international sanctions known as smart sanctions. The date of international sanction, especially after the establishment of the United Nations, let to many applications that enphasized the need to punish the international violator and an institutional system was established in order to implement it. However, many obstacles stand in the way of activating the international sanction , including selectivity, duality and the effect of the right of veto, as well as taking a number of pretexts to apply the international penalty in line with the policies of the major powers.

RESUME :

La sanction internationale est l’un des problèmes les plus importants de l’heure et l’un des plus grands défis de notre époque , compte tenue de l’expérience de la communauté internationale quant à la gravite des violations internationales des dispositions du droit international. La sanction internationale est toute mesure ou mesure appliquée contre le contrevenant international avec la nécessité de respecter le principe de légalité à cet égard et de respecter tous les principes des Nations Unies lors de sa mise en œuvre, en particulier le principe de protection des droits de l’homme, c’est peut-être le motif le plus important qui a conduit à la recherche d’un nouveau type de sanctions internationales appelées sanctions intelligentes. La date de la sanction internationale, en particulier après la création de l’organisation des Nations Unies, a donné lieu à des nombreuses demandes insistant sue la nécessité de punir le contrevenant international et un système institutionnel a été mis en place afin de le mettre en œuvre. Cependant, de nombreux obstacles empêchent d’activer la sanction internationale, notamment la sélectivité, la dualité et l’effet du droit de VETO sur les résolutions pénales internationales, ainsi que l’utilisation de plusieurs prétextes pour appliquer la sanction internationale conformément à la politique des grandes puissances.
